The “I Do at Sandals Video and Crowd-Sourced Wedding” Contest (the “Contest”) is intended for legal residents of the United States of America (“USA”) and Canada (excluding the province of Quebec; where this Contest is void) and shall only be construed and evaluated according to the laws of the USA and Canada.
SPONSOR/ADMINISTRATOR: The Contest is sponsored by Unique Travel Corp. the worldwide representative of Sandals Resorts, located at Calle Aquilino De Guardia, No. 8, IGRA Building, Panama, Republic of Panama (the “Sponsor”) and administered by American Sweepstakes & Promotion Co., Inc., 300 State St. Ste. 402, Rochester, NY 14614 (the “Administrator”).
ELIGIBILITY: The Contest is open only to legal residents of the USA and Canada (excluding residents of the province of Quebec) who are at least eighteen (18) years of age or who have reached the age of majority whichever is older in their state (or province) of residence at the time of entry; a couple that is engaged to be married and willing to be legally married within the time frame specified in these Official Rules OR a couple already married and willing to renew their vows within the time frame specified in this Official Rules. In these Official Rules the couple shall be referred to herein as (the “Entrants”). Employees, officers and representatives of the Sponsor, the Administrator, their respective parent companies, employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives and advertising and promotional agencies, and the officers, directors, agents, and employees of each of the foregoing, and members of their immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above (collectively, the “Released Parties”) are NOT eligible to participate in this Contest. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Void in Puerto Rico, U.S. territories, and where prohibited or restricted by law. (For the avoidance of doubt, any references in these Rules to Entrants shall also include the couple who is deemed the winner (as defined below)).
AGREEMENT TO OFFICIAL RULES: By participating and submitting an application inclusive of personal data and personal details, those who enter the Contest agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Contest. Winning the Grand Prize (defined below) is contingent upon fulfilling all requirements set forth herein.
TIMING: The Contest will be defined by the three (3) following time periods:
The Sponsor’s website database clock is the official time-keeping device for the Contest.
HOW TO ENTER: During the Submission Period, eligible Entrants can be entered into the Contest by going to the Sponsor’s website, contest.sandals.com (the “Website”), completing the Contest registration form (the “Registration Form”) requesting Title, First Name, Last Name, complete mailing address, phone number, mobile number and email. In addition, the Entrants must submit a video with both individuals (not to exceed 90 seconds in length) showcasing their story of unique love and the reason why they deserve the opportunity to win a customizable wedding or Re-tie the Knot (“vow renewal”) ceremony and a stay in a voter selected honeymoon suite at a designated Sandals Resort (the “Theme”). To be valid, the Registration Form must provide all requested information. Each completed online registration and Theme-applicable video received during the Submission Period will account for one (1) valid Contest entry. The Entrant is responsible for all costs associated with entry. Limit one (1) entry per Entrant/couple. In the event that more than one of exactly the same video is submitted, or video that is modified yet about the exact same couple is submitted, only the first submission received shall be accepted. By entering the Contest, the Entrants shall be deemed to have agreed to have their entry information made available to the Sponsor and Administrator.
The Website contains materials that is owned by or licensed to the Sponsor. The Entrants may not copy, reproduce, download, upload, post distribute, republish, retransmit, perform or modify in any way any of the materials on this Website, including without limitation, any images or written material without the Sponsor’s prior written permission. All rights and licenses not expressly granted to Entrants in these terms are reserved for the Sponsor.
ENTRY REQUIREMENTS/RESTRICTIONS: Once submitted, an entry cannot be deleted, canceled or modified. In order to be eligible, entries must be received by Sponsor during the Submission Period. Entries received by Sponsor before the start of the Submission Period or after the end of the Submission Period will be discarded and deemed VOID. For purposes of this Contest, an entry is “received” when the Website’s servers record the entry information. Proof of submitting a Contest entry form online (such as an automated computer receipt confirming entry or “thanks for entering” screen or message) will not be deemed by Sponsor to constitute proof of actual receipt by Sponsor of an entry for purposes of this Contest. Those who do not follow the instructions, do not provide the required information in their entry form, or do not abide by these Official Rules or other instructions of Sponsor will be disqualified. All entries become the property of Sponsor and will not be returned or acknowledged. Entries made by any other individual or any entity, and/or using any e-mail address other than the Entrant’s or any other website, including, without limitation, commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified. The submission of an entry constitutes the Entrants representation of eligibility, consent for both parties to participate in Contest and consent for the Sponsor to obtain, use, and transfer Entrants names, address, likeness, video and other information obtained through the Registration Form or entry for the purpose of Contest administration.
The Entrants collectively and individually represent and warrant that their submitted entry is the original work of the Entrants, has not been previously published, has not won previous awards, and does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity and must have been created in a legal and safe manner. If the entry contains any material or elements that are not owned by the Entrants or provided by the Sponsor, and/or are subject to the rights of third parties (i.e. music. Logos, trademarks), the Entrants shall be responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who appears in or is identifiable in the entry (collectively, the “Clearances”). By submitting an entry, the Entrants collectively and individually represent and warrant that they collectively and individually consent to the submission and use of the entry inclusive of the video in the Contest.
By submitting an entry, the Entrants collectively and individually: 1) irrevocably grant the Sponsor the royalty-free, non-exclusive license throughout the world to use, re-use, copy, publish, republish in whole or in part, edit, add to, modify, and rearrange the entry in whatever media, including without limitation edit, rearrange, and/or copy the entry for use in the Contest of Sponsor's products and services, without further permission, consideration or payment to the Entrants, except where prohibited; 2) warrant and represent that the Entry is entirely the original creation/work of the Entrants and that use of the Entry as described herein will not violate any law or infringe upon the rights, title, claim or interest of any third party; 3) certify that the Entrants are the creators and sole copyright owners of the Entry; 4) all statements made in the Registration form are true; 5) fully understand and acknowledge that any discrepancies, misstatements, omissions and/or falsifications may in the Sponsor’s sole discretion disqualify the Entrants for consideration as participants in the Contest; and 6) that the Released Parties are fully relying on the accuracy and completeness of the Registration form.
Entries may not contain any image or depiction of the following: (i) materials which include or constitute trademarks, trade names or copyrighted works created or owned by any person or entity other than Entrants or for which the Entrants have obtained owner’s written permission to use (Sponsor’s discretion); (ii) materials bearing profanities, or bearing the name or likeness of any celebrity, living or dead; (iii) materials which contain visible identifiable or potentially identifiable information, including but not limited to, phone numbers, website links, street addresses, e-mail addresses or license plate numbers; (iv) inappropriate behavior for a general audience; (v) any depiction of real or simulated sexual acts; (vi) violence in any form; (vi) materials which violate anyone’s reasonable privacy expectations, violate any known agreement, or which are defamatory in nature; (viii) materials which are derogatory to Sponsor, or any affiliated entity or person; (ix) materials which are discriminatory based on race, religion, national origin, physical disability, age, sex, or sexual orientation or preference; (x) materials in which any person identifiably appears unless Entrants have obtained an appropriate written release from such person granting all rights required herein; and, (xi) materials which do not comply with all other requirements in these Official Rules. Entries that do not conform to these guidelines will be disqualified. Sponsor reserves the right to reject or disqualify any entry which Sponsor, in its sole and absolute discretion, determines to be inconsistent with the letter or spirit of these Official Rules or potentially damaging to its, the Contest’s, or another’s image or reputation.
GENERAL CONDITIONS: If for any reason the operation or administration of this Contest is impaired or incapable of running as planned for any reason, including but not limited to: (a) infection by computer virus, bugs, (b) tampering, unauthorized intervention, (c) fraud, (d) technical failures, or (e) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, for any reason including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Contest, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by the Sponsor, in its sole discretion without notice and award the Grand Prize (defined below) using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. Sponsor reserves the right, in its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or Sponsor’s Website; or (b) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Contest, the Entrants individually and collectively agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Contest; (c) printing errors; (d) errors in the administration of the Contest or the processing of entries; or (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
WINNER DETERMINATION/NOTIFICATION: Following the conclusion of the Submission Period, the Sponsor will commence the Voting Period of the Contest. During the Voting Period, the Sponsor will make all eligible Contest entries available for public voting within the Contest tab/application. The general public will be invited to visit the Website and vote for the one (1) entry that they find most deserving of the Grand Prize. Limit one (1) vote per person PER EMAIL ADDRESS per day. The Sponsor reserves the right, at its sole discretion, to disqualify any vote(s)/voter(s) deemed to be (a) tampering or attempting to tamper with the Voting process; (b) submitting more than the maximum number of votes allowed per day; or (c) violating these Official Rules in any way. In addition, Entrants (or voters) are not allowed to use or promote the use any voting board or voting forum to increase their vote total. Any Entrant/voter suspected of using or promoting use of a voting board or voting forum may be subject to disqualification, at the Sponsor’s sole discretion. Entrants/voters may not incentivize voting through the use of personal giveaways, Sweepstakes, or Contests. Any Entrant found attempting to violate or encourage violation of the voting limits and restrictions will be disqualified. The ten (10) Entrants that receive the most votes during the Voting Period will be named the Contest Finalists (“Contest Finalists”). Regardless of the results of the Voting Period, ultimate Contest Finalist determination is subject to the Sponsor’s approval.
Following the conclusion of the Voting Period, the Sponsor will commence the Judging Period of the Contest. During the Judging Period, each Contest Finalist entry will be reviewed by a qualified judge or panel of judges appointed by the Sponsor. Each entry will be judged based on the clear relationship between the submission and the following criteria:
The Contest Finalist that receives the highest score based on the Judges’ review will be deemed the potential Grand Prize-Winning Couple. The potential Grand Prize-Winning Couple will be contacted and qualified (via telephone/email) by the Administrator on or about December 21, 2019.
GRAND PRIZE & PRIZE CONDITIONS: There will be one (1) Grand Prize awarded. The Grand Prize-Winning Couple (the “Couple”), upon the Administrator’s confirmation of eligibility, will receive the following “Grand Prize Package”:

(3) **ReTie the Knot (“vow renewal”) - a copy of your marriage certificate must be submitted at least sixty (60) days prior to travel and the original marriage certificate must be hand carried to the designated resort.

Anything that exceeds the items listed above for the Customizable wedding or ReTie the Knot ceremony must be discussed with the wedding planner, decided and fully paid for sixty (60) days prior to arrival. All accounts must be finalized within 60 days of arrival.

The Couple will have the opportunity to invite more than the stipulated twenty (20) guests. ALL guests attending the wedding or ReTie the Knot (“vow renewal”) ceremony shall be responsible for their own airfare and accommodations costs. The Winning Couple shall be responsible for the additional food and beverage cost for the cocktail and dinner ceremony. All weddings with five (5) rooms or more are considered a group and shall be subject to the terms and conditions of a wedding group. At point of having a wedding group, a group code will be issued for up to 25 rooms. For wedding groups with 26 rooms or more, a group contract will be required. Wedding passes or Day passes for offsite guests not staying at a Sandals or Beaches resort will be limited to a maximum of 20% of the bride’s and groom’s total guests count in order to obtain resort access. Day pass rates vary by resort and are subject to change without notice. Wedding passes or Day passes for outside guests can only be purchased 60 days prior to arrival. Residency period: 48 hrs. (must include two business days, NOT including day of arrival, weekends or holidays). All original documents with certified court seals must be hand carried to the island. In addition, copies of these documents must be faxed or scanned copies must be uploaded to the UTC Wedding Document department: Country-issued passports and state issued birth certificates for BOTH bride and groom ; All previous divorce decrees, all pages of court certified final judgment for BOTH bride and groom (if applicable) ; Former spouse’s state-issued death certificate and related marriage certificate (if applicable) ; Legal adoption papers or legal name change (if applicable) ; Legal translation of all documents to English along with documents in original language (if applicable). In addition, for non-express weddings, scanned copies of these documents must be faxed or uploaded to the UTC Wedding Document department: Country-issued passports and state-issued birth certificates for BOTH bride and groom; All previous divorce decrees, all pages of court certified final judgment for BOTH bride and groom (if applicable); Former spouse’s state-issued death certificate and related marriage certificate (if applicable); Legal adoption papers or legal name change (if applicable) ; Sworn affidavit or letter from a Notary Public: must be on a letterhead with applicable notarized, seals etc. attesting that neither party has not been previously married ; Legal translation of all documents to English along with documents in original language (if applicable). For Express Weddings: Residency period of 48 hrs., must include (1) business day. Fee of US$190 is due at time of booking (this fee to be waived by contest sponsor). Notarized copies of all documents that apply along with the Marriage License Application Form, must be sent to the Wedding Documents Department. Please note that documents will not be returned. Residency period: 48 hrs. (must include 2 days which includes day of arrival, weekends and holidays). All copies of documents must be notarized and mailed to our office. Please note that Notary’s commission must be valid until after the wedding date: Notarized copies of BOTH bride and groom’s valid government-issued Passport photo ID or Driver’s License ; Notarized copies of BOTH bride and groom’s state-issued birth certificates; Notarized copy of all previous divorce decrees, all pages of court certified final judgment for BOTH bride and groom (if applicable) ; Notarized copy of former spouse’s state-issued death certificate and related notarized marriage certificate (if applicable) ; Notarized copy of legal adoption papers or legal name change (if applicable) ; Notarized copy of legal translation of all documents to English along with notarized documents in original language (if applicable) ; Please note that documents will not be returned. Documents must be received in our office at least 60 days prior to your arrival date for wedding confirmation. Please note that in the event that all applicable required documents are not received by our office we will not be able to perform the wedding.
Voting for the bride’s wedding gown will be open to the public for five (5) days (January 20 - January 24, 2020). The public will be able to cast one (1) vote per day per email address.
Voting for customizable wedding ReTie the Knot (“vow renewal”) ceremony Inspirational look & feel (e.g. tropical, passionate classic, botanical, modern, etc.) will be open to the public for five (5) days (January 27 -January 31, 2020). The public will be able to cast one (1) vote per day per email address.
Voting for the wedding or ReTie the Knot ceremony décor (inclusive of the non-floral décor setting) that ties with Inspiration will be open to the public for 5 days (February 3 - February 7, 2020). The public will be able to cast one (1) vote per day per email address.
Voting for a specialty bar and signature cocktail will be open to the public for five (5) days (February 10 - February 14, 2020). The public will be able to cast one (1) vote per day per email address.
Voting for cake flavor and design will be open to the public for five (5) days (February 17 - February 21, 2020). The public will be able to cast one (1) vote per day per Email address.
Voting for an Island Route’s tour which the Couple will experience will be open for five (5) days (February 24 - February 28, 2020). The public will be able to cast one (1) vote per day per email address.
The voting results and decisions of the public/Sponsor are final and binding.
The Sponsor reserves the right to advise the confirmed Winning Couple of the need to relocate them from the resort selected by unanimous vote to an alternate resort for the secured travel dates subject to availability in the event of Force Majeure. Force Majeure means any circumstance(s) beyond or outside of the resort’s control including without limitation, acts of God, adverse weather conditions or natural disaster, interruption to travel, epidemic or pandemic, terrorist attack, civil war, civil commotion or riots, war, armed conflict, or threat of or preparation for any of the same, imposition of sanctions, embargo, or breaking off of diplomatic relations, any law or any action taken by a government or public authority, any labour or trade dispute, strikes, industrial action, or any illness or otherwise. In the event of Force Majeure, the Sponsor shall not be responsible for any airline changes or penalties each wedding guest shall be subjected to due to relocating the bride and the groom to another location for the wedding or ReTie the Knot ceremony. All wedding guests’ accommodations to the alternate resort shall be subject to availability and the terms and conditions of the group contract.
By accepting the Grand Prize, the Couple consents to their Sandals Resorts Wedding or ReTie the Knot (“vow renewal”) ceremony to be photographed and filmed and to be used for promotional and advertising purposes in all media (printed publications, promotional campaigns, social media, internal communications, broadcast news/features and websites) now known or hereafter devised throughout the world without further payment or additional consideration, and without review, approval or notification unless prohibited by law.
The Approximate Retail Value ("ARV") of the total Grand Prize is: $25,000 USD. The ARV will vary depending upon points of departure and destination and seasonal fluctuation of resort rates and airfares. The Winning Couple shall not be entitled to the monetary difference between the actual value of the Grand Prize package and the stated ARV. The Grand Prize is not redeemable for cash. The Couple must accept the entire Grand Prize package; the Couple cannot accept select portions of the Grand Prize package listed above. No substitution, assignment or transfer of the Grand Prize or any portion thereof is permitted, except by Sponsor, who reserves the right to substitute the Grand Prize or a component of the Grand Prize with another of comparable or greater value. Travel, hotel and other accommodations for the Couple’s guests are subject to availability. The Couple must travel on same itinerary. No extension will be given. All travel dates are subject to change in the Sponsor’s sole discretion. The Couple and their guest must obey all local laws regarding lodging restrictions.
Exclusions: All expenses and incidental travel costs not expressly stated in the Grand Prize package description above, including but not limited to; ground transportation where the Couple reside, Red Lane® Spa treatment and services, specialty dining (other than what is specified), personal charges at lodging, telecommunication charges, security fees, taxes, tours and excursions, inter-island transportation, SCUBA certification courses, island departure taxes, purchased made at Sandals Specialty Shops or other expenses or incidentals are the sole responsibility of the Couple. The Sponsor is not responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air transportation carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. The Sponsor shall not be liable for any loss or damage to baggage and/or personal property. The Couple are solely responsible for obtaining documents necessary for their respective international travel (i.e. passport/visa), if applicable. Restrictions, conditions and limitations may apply. The Couple is responsible for all taxes and fees associated with Prize receipt and/or use.
By accepting the Grand Prize, the Couple collectively and individually agree to release and hold harmless the Released Parties, each of their affiliated or related companies, and each of their respective officers, directors, employees, shareholders, agents, successor and assigns from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the Grand Prize. The potential Grand Prize Winning Couple must each sign and return to the Administrator, within seven (7) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility and Liability/Publicity Release (if U.S. resident) or a Declaration of Compliance (if Canadian resident) in order to claim the Grand Prize. Note: The Affidavit sent to US potential Winners will require that the Winners provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Grand Prize-Winning Couple will be responsible for all local, state, and federal taxes associated with the receipt of the Prize. The Grand Prize-Winning Couple must note that the value of the Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winners for the value of the Prize (applicable to US Winners only). The Couple is solely responsible for all matters relating to the Prize after it is awarded. If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential winner, if a potential winner cannot be reached within three (3) business days from the first notification attempt, or if a potential Winner fails to return requisite document(s) within the specified time period, or if potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Winner may be selected.
By accepting the Grand Prize, where permitted by law, the Couple grants to the Released Parties and those acting pursuant to the authority of Sponsor and the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time their full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS CONTEST OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Contest or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize. The Winner also acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize.
DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants, Administrator, and Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the Republic of Panama, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws. By participating in the Contest, Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, shall be resolved individually without resort to any form of class action; (ii) any judicial proceeding shall take place in a federal or state court within the Republic of Panama; (iii) any and all claims, judgments , and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event will attorney fees be awarded or recoverable; (iv) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (v) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief.
SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.
MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Contest and supersede all prior and contemporaneous agreements, representations and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by both Sponsor and Administrator. The waiver by Sponsor or Administrator of any provision of these Official Rules shall not constitute a waiver of any other herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, Administrator, and Entrant.
